If you're sentenced, and you're in prison, you just have your time to do; bail is something you can post while you're fighting your case.

Now, there could maybe be bail by appeal; that would be something that would have to be set by an attorney.

Sometimes it's an advantage for somebody to be out, so that they can fight their case and not be in custody.
