Nothing is worth the litigation bat especially when you just inherited the basis of the code yourself. Guy couldn't even get versioning right until it was told to him.

You threatened him with the idea of litigation 1st post not just 'wrote', maybe your 'tude made him change his mind and he left it up after seeing how you handled it.(honey and vinegar expression) If it wasn't your emotions driving this you would have started with "for now just change the pictures and we can work this out behind the scenes" or anything relatively close to that. You say he could have friended you to ask permission but why didn't you friend him instead of starting to threaten him in comments? No one at all had debated that it wasn't proper to just do it like he did, no one is saying you don't have ownership over it. But what people are saying is that you chose the 'corporate' method and immediately threatened him.

here in short the timeline:
- Mod got ripped and patched, first description said he overtook it
- I wrote with him, and told him to please unlist it here
- He aggreed but didn't unlist
- Now the rightholders of the trademarked logo in the preview pick is pissed at me after I trusted in Liberators words
- now the report and DMCA is real (reason why it is a MUST is in my long describing post of the situation)
- Users who still use this copy here when it gets removed may end in a corrupted savefile because they cannot use it till it runs out of compatibility.

That's the whole story... and beside of that I pointed out, that Liberator several times accepted and continued while updating that he is the original author but yeah... he is the good guy... I don't understand people sometimes...

But hearing it all, I see that Iiberator didn't do anything really wrong and this would ALL have been resolved if the Original dude actually message Liberator to let him know that he is continuing the mod AGAIN after leaving it fallow .. and OFFER Liberator a chance to collaborate.

so for real... what do you think I could do there? I have no other choice to do it this way, beside of that you should see, that it's a free content and I invested all that work without getting a single dollar for it... and now 4 days later, he changed the Description but hasn't unlisted it, it's till ontop on the most popular mods atm....

And I don't need to write that I forbid that people works on it, because Necesse annoys you TWICE on every upload try to the marketplace, then you get redirected to the Workshop page here and your mod is private and unlisted and then you have to accept a ToS with CAPSLOCKED RED LETTERS THAT YOU'RE NOT ALLOWED TO UPLOAD THE WORK OF OTHERS.

I would have been available to get contacted and I probably would have fixed it earlier in case I realized that the release was already, but I just forgot it because of super stressful days I had.... but there wasn't anything like a friends Request.... the title of this Mod here was just something like: The updated version here you go!
and NOT: Unless the original creator does an update, that here is a workaround.

So you in my position, what would you do now? and what you should know, when you use the Dev Version and then upload a mod... you have to read a message that you HAVE to read the Workshop ToS and wait 5 seconds till you can click "continue" then comes a message: "is this REALLY your work? You're not allowed to upload something if it's not the case" and in this window, you have to wait another 10 seconds till you can continue to the Upload Process.

And the Gap I left were just a little week... when you drive into the holidays, there is also a gap in which your home is unused and you probably wouldn't be happy if someone else would life inside that House when you return right? sitting on your sofa, cooking coffee in your kitchen.
And THAT's the case here...

The Cooper(ation) Team HAS to do an DMCA, because it's a registered trademark and this version here is signed with the Community (no profit) version of the IDE IntelliJ, so if they don't start a DMCA and the publishers of this IDE, they see here the Picture with the Trademarked logo of the Cooper(ation) Team together with a community version signed jar file.... so if I would say "ok let him hold it and everything is fine" maybe this community which just gave me the possibility to do it to pay thousands of USD because of using a free private version as a commercial group.

This version here not even has changed the preview Picture, it's nothing selfmade.... it's taking weeks of work and a lot of love invested, investing 10 minutes of fixing, even just copycatting the preview Picture and claiming it as own work.

If he would have took the work and write into it: this is a fix for these waiting for an update of the original creator.
Everything would have been fine, but what he did was calling it a "continued version" and when you read the messages here and under the original Post, I already wrote that and he said: that's ok and we also said, that he UNLISTS it, so you still could use that fix here but noone new could find... the original would be back in the most popular Mods instead of that "piracy fix" here.

Infact, the fix, which I did myself in the original was 3 things: changing the version number, and use a search and replace function in the IDE and replacing 2 strings in the modfiles because class directorys changed.

I want to defend myself here, what you have to see is, that I worked weeks on that mod, when I overtook it I:
Got in contact with the former creator and the first initial creator and asked them for their ok, because otherwise you break the Valve Workshop ToS.

When I overtook it, the whole script was 280 lines long (just checked it)
after my rework, it were over 7000 lines of code made.
The Software I use for that is sponsored by the Cooper(ation) Team and they also branded it for me so even when a former creators trys to claim it back or to DMCA me, they would pay the international law costs (which can easily be thousands of USD in a DMCA case)

@Liberator,

I prefer to support this mod solely because the behavior of Agath. They went ghost and left their mod inoperable so someone was kind enough to the community to fix it and keep it going. Then dude comes back instead of being nice and saying: "hey i appreciate keeping it going while i took a break and was gone. Would you mind maybe transitioning back to my mod and telling people to return to the original?"

He COULD have done that, could have been mature. Instead freaked out and spazzed trying to threaten legality... over a mod. @Agath, whatever you are going through i hope it passes, but don't trying to scare other people or intimidate anyone because they tried to fill a gap YOU left. Next time if you want the slightest right to freak out on someone you best be putting that you are on a break on your mod page and that you forbid any work on it.

TL:DR take my points and up rating for being a community member that kept a nice mod going when the creator seemingly abandoned it! :)

I'm really glad there's a working version of this mod still up on the workshop. All the other ones have version incompatibility.

tl;dr main mod author decides to DMCA and sue immediately because Liberator didn't contact them. Turns out that as of this posting, the Liberator version is ironically the only one functional, as Agath hasn't been able to update the versioning compatibility to 1.0.0.

I have talked to the creator in the comments in the original, in case Steam Support checks the report (because I cannot cancel it anymore) we're good now, so please don't give Liberator some penalty, I guess that was a lesson for both sides....

for him about behaviour with content of others...

for me about api changes on final releases and that I should be quick with changes and/or atleast give a statement in time.

Please Support our work and don't use that piracy work here, I just talked to my crew and we will sue him for DMCA and Piracy behaviour.

I don't want to judge about anyone who used it in the meantime, and a temporary upload and maybe a try to contact me would have granted him the right to do that... but nothing of that happened.

You may loose your miners and all the content in your safegame if you stay on that piracy version, please switch back to the original and licenced version before that happens to not loose anything.

Probably that will work without issues, because I checked the version here and it's just 99% copy and paste with a little bit of hotfixing.

Not using it but favorite and liked it, to help promote it for those that don't like to go out and mine for themselves.
