Don't worry, there is a lore friendly reason
The player character learned a trick when he/she was in his or her childhood, where they could talk and scream through the spine hole.

Until you go back to Helgen and collect your head, all you can say to an NPC is "sputter, sputter." Then you buy a cape, a horse and a battleaxe. An age of terror begins.

For the author of this " mod " , it's a joke . I respect that . But you , people , are you crazy ? You really like to play skyrim with a character without head ? And where do you see a bug ? The first man is decapitated , the second is the player character , who escape to death when the dragon attacks .

Hey bro I think the reason the headsman didn't chop of his head is because remember Alduin used the dragon shout which knocked the headsman on his knees. If I remember correctly you can even see like an energy wave but it might be a hallucination lol. Still this mod seems cool I guess I might actually try it at one point.:-) By the way idk why but I always found the headsman cute haha.

Heads up, mod doesn't work so don't get aHead of yourself. The modder should go aHead and fix it.
