As of July 29th 2016. Nividia has been successfully sued due to false advertisment.
The claim was that the GTX970 was unable to run like it was claimed to be. further investigation reveals that the 970 is actually 3.5GBs DDR5 not 4.0GBs and uses much smaller cache then advertised!

So?

Well. submit your claim if you have a GTX 970 and you WILL recive $30, via paypal, steam, or other means.
