That's issue you are having is more of a standard game issue where it will equip a unit with the highest tier gun. So if the SMGs are considered a higher tier it will autoequip that over the ShIv cannon. You can still manually equip the SHIV guns still so no big deal.

So since I use not only this shiv mod but also BU and WIO SMG Plugin it's been sometimes spawning in with the smg and not there shiv cannon

Oh wait you cannot see or equip the shiv cannons in your game? That is odd. Might be an issue with buildable units.

That's BU's doing for pretty much all of there units and it does give them there proper weapons
the problem for the Shivs is that they still have access to the SMGs

Probably cause in LW the SMG's count as an assault rifle and not there own category of weapons?

Well the shivs can access other weapons besides their Cannons. That is a purposeful design. If you can equip them with their cannons then do so. the other guns are there for alternate weapon options.
