This topic has come up before and I've replied to people, mostly kickstarter backers in private about it. Nicalis came on board during the Kickstarter campaign as a developing partner and a publisher, they own the game and any public updates must come from them.

All the kickstarter backers have received a Steam Key for the Takeover as compensation and everyone that has requested a refund has got their money back.

Unfortunately I can't get in to more details, if I could I would have done so a long time ago.
