Are you saying that you're "stuck" at 60 Hz and you want to use something higher? If so, my first question would be "Why?". It doesn't seem like that would get you anything in this game.
But, aside from that, anything over 60 Hz is likely to cause problems in this game (based on my experience, and countless posts in this forum).
Or did "Locked at 60 Hz?" mean something else?
the game blacks and resets my monitor due to a Hz change and i have to alt tab from time to time so i was hoping to stop it, but from what i gathered lower resolutions let you change Hz at the cost of screen size and it still causes the black screen because of they are not my native resolutions.
You don't have multiple monitors, do you? Just checking, because that's another thing that has caused problems for some.
Unfortunately, I'm not sure what to suggest for the problems you described. I think someone once said that turning on Steam's "big picture" mode fixed a problem. I've never used it and have no idea if it will help you. Just throwing it out there. Or maybe try playing on a TV. Other than that, maybe check the video card drivers to see if there's something there that will help (locking in the refresh rate or something like that).
Oh, and someone recently posted a PSA topic with a number of suggestions for Lego games. I think their suggestion to turn of V-Sync is generally a bad idea for this game, but they had a number of other things that might be worth a look.

What you described doesn't sound like the usual V-Sync problems in this game, but I'll throw this out anyway ...
Check your video card drivers to make sure that they aren't affecting the V-Sync setting in the game. For example, the AMD drivers can be set to disable V-Sync in everything; and they have an "enhanced sync" option that overrides the regular V-Sync, and using that can cause problems in this game. You can have Steam, or something else, display the frame rate while you're playing, to make sure that it matches the rate shown in the game settings. That is assuming, of course, that you can actually play the game (I'm not sure, from what you posted, if you're actually able to play the game at all).
