Commercial Use
I am working on a video game with static images in place of cutscenes like a graphic novel. Can I use the figures created in Flex and sell my game without paying royalties?

Hey, sorry I missed this post. As I've mentioned elsewhere I personally don't have any problem with you using the images for commercial purposes. However, the original character and clothing models are licensed through the standard Unity Asset store license, and in their agreement the commercial use of images made with asset store content, created by an end user isn't specified. So, they basically haven't thought to develop any legal language around it. This is kind of a similar gray area to game streaming, where technically streamers are making money by broadcasting gameplay content which they have a right to USE but not necessarily reproduce commercially.

So without Unity specifying this specific usage then I unfortunatley can't give you a 100% legally sound answer. But for all practical purposes going ahead and using them isn't an issue. If you were to get to the point where you're making enough money where the original IP holder of (lets say a piece of clothing) notices you're using their content, you could easily just acquire the license to reproduce that content and be in the clear. But the chances of them actually caring (since they put the content on the asset store in the first place) are pretty negligible, I think.

For the base character model it's actually much easier for you to get a commercial reproduction license. Since the base character is a Daz Genesis 3 model, you can just sign up for a Daz account, and the rights to use that character are part of that account creation agreement.

This is a big gray area that is just getting figured out (especially with the rise of NFTs featuring digital content). What I can do is reach out to Unity and see if I can get them to clarify their stance on end-user commercial usage for Asset Store content.
